Motion to approve the Committee of Adjustment Agenda, as amended. Motion to Amend
seconded by Lesley Thompson
Carried
That the Committee approve the requested consent, subject to the following condition: 1. That a copy of the updated registered survey/plan for the new lot be submitted to the City. Reasons: 1. The proposed consent facilitates increased density 2. The proposed consent does not inherently introduce any new incompatibilities with surrounding land uses. 3. The resulting lot fabric requires frontage and lot area reductions to current provision in the zoning by-law. These proposed reductions are being applied for through concurrent minor variance applications A-08-26 and A-09-26.

Recommendation That the Committee approve the requested minor variances.
Moved by Vincent Foy, seconded by Lesley Thompson
Carried
That the Committee approve the requested minor variance subject to the following conditions: Condition(s): 1. That a revised site plan be submitted to the City staff for approval demonstrating a reduced driveway width of 4.8 m adjacent to the existing mature tree. There are no concerns with the requested width within the private property. Note(s): 1. The existing surface drainage patterns shall be maintained. Any alteration to the existing topography shall incorporate good lot grading practices such that any surface water runoff is directed away from the adjoining properties.

That the Committee approve the requested minor variances, subject to the following condition: 1. A lot grading plan shall be submitted to the satisfaction of the City prior to the issuance of a building permit for the proposed development. The lot grading plan shall clearly demonstrate that positive lot drainage can be achieved with the reduced side yard setbacks. Any storm water runoff associated with the proposed construction shall outlet to the right-of-way and not directed towards adjacent properties. 2. That a copy of the updated registered survey/plan for the new lot be submitted to the City. Reasons: 1. Proposed variances would not facilitate a form of development that would introduce any new land use incompatibilities. 2. Proposed variances facilitate the provision of required parking spaces within the zoning by-law on a narrow lot. 3. Proposed variances will not disrupt the character of the surrounding established neighbourhood.
